PPP Endorses President Mahama’s Suspension of Chief Justice, Slams GBA’s Opposition

The Progressive People’s Party (PPP) has thrown its weight behind President John Dramani Mahama’s suspension of Ghana’s Chief Justice, describing the move as constitutional, lawful, and procedurally sound.

In a statement issued on April 28, the PPP emphasized that the President acted on the advice of the Council of State after a prima facie case was established, in accordance with Article 146 of the 1992 Constitution.

The party further noted that the Chief Justice had been given an opportunity to respond to the allegations against her, indicating adherence to due process.

“This process, in our view, unequivocally demonstrates the President’s commitment to adhering to laid down procedures, upholding the rule of law, and respecting fundamental human rights,” the statement read.

The PPP expressed disappointment with the Ghana Bar Association (GBA) over its call for the reversal of the Chief Justice’s suspension. The party described the GBA’s position as “perplexing” and warned that it could potentially undermine the constitutional order. “Their call for a ‘suspension of the CJ’s suspension’ is perplexing and could be interpreted as an attempt to suspend due process itself, potentially setting aside portions of our Constitution,” the PPP said, adding that such actions threaten democratic principles and promote selective application of the law.

Further stressing the need for equal accountability among state actors, the PPP argued that no individual, regardless of office, is above the law. “The privileges, conditions of service, powers, and the honor bestowed upon the heads of the three arms of state necessitate that they are held to the highest standards of accountability,” it noted.

Drawing a parallel with the 2018 removal of the Electoral Commission Chairperson, the PPP said that the precedent underscores the importance of constitutional compliance and due process, even for the highest public officeholders. “In our defense of the Chief Justice, we must not lose sight of the essential requirements of accountability, due process, the rule of law, and absolute compliance with constitutional provisions.”

The statement, signed by PPP National Chairman Nana Ofori Owusu, concluded with a call for calm and respect for the constitutionally outlined procedures. “We call upon all parties to remain calm and allow the constitutional processes to proceed without hindrance,” it urged.
