Bissue’s Lawyer makes strong case to be furnished with Anas’ petition to OSP – Skyy Power FM

Counsel for Charles Bissue, Nana Agyei Baffour Awuah Esq., has impressed on the court the need for the grant of a motion for discoveries in the pending application for an injunction against the Office of the Special Prosecutor, which seeks to restrain the latter from investigating and prosecuting his client in respect of allegations contained in the Galamsey Fraud Part 1 documentary.

According to Nana Agyei Baffour Awuah argued in court that it would be improper to ignore the claims as established in the petition that invoked the powers of the OSP to investigate Mr Bissue.

Pressing further, counsel for Mr Bissue said the motion for discoveries will afford the court all the evidence in the determination of the injunction application and other related matters.

“…in order to assist the court to do justice to all the relevant facts and evidence that document must be available to the court.

“After the filing of a motion for an injunction, the necessity of the document that we seek became apparent because of an article by the former Special Prosecutor. It was not as though, we knew of it at the onset that we failed to raise it. But for that petition, we wouldn’t even be in court” he emphasized.

Nana Agyei Baffour Awuah had earlier indicated that the former Special Prosecutor, Martin Amidu publicised that it was Kissi Agyabeng (current Special Prosecutor) who authored the petition to invoke the powers of the OSP to investigate Charles Bissue, and the entirety of the allegations contained in the Anas Aremeyaw Anas’ “Galamsey Fraud Part 1” documentary.

Counsel for the Office of the Special Prosecutor, Isidore Tufour urged the court to discard the motion for discoveries on grounds that it had no bearing on the substantive matter. In his view, the two are not related in any sense to be considered by the court in respect of a determination of the injunction application.

“The presentation made by Nana Awuah is misleading especially when conceived within the framework of the law.
The application for an injunction is founded in the statement of claim.

“In his pleadings, there is absolutely nothing referring to the document he is seeking the first defendant to produce.”

The court has been adjourned to 4 July 2023.
