Promises made when making out cannot be subject of law suit – Justice Abdulai

Legal practitioner and law lecturer at the University of Professional Studies (UPSA) Accra, Mr Justice Abdulai has said not all promises made in relationships are subject of law suit when breached.
Speaking on TV3 NewDay on Wednesday monitored by GhanaPlus.com, he said one of such is promises made during intimacy.
He explained place regardless, such promises does not hold in the law court due to emotions involved.
“There are circumstances that if you make these same promises to a woman or even a man, you cannot be taking on so when you are in your bed room making out, if you make these promises the court takes it as not a promise that may be kept because of the mood of the very specific circumstance”.
“…so if you are making out regardless of the place whether in your car or in your bedroom or in a hotel wherever, if you are making out and you make these same promises or more, in fact, under that circumstances, you are even allow to buy God for another person if you can or take a person to the moon but those once cannot be a subject of a suit. In fact, indeed if it became a subject of suit it will be thrown out most likely”.
Justice Abdulai however, explained promises made when one is under no emotional influence count in count and has there urged people to be weary of the promises they made so not to land them in trouble.
“…but when theses promises are made in a normal settings that you are not compelled either by way of mood physiologically or because the person has her hand in your ears so these once there are with the intention to keep them and when you also make an attempt to keep some of them, then it indeed become a subject of a suit and you may be compelled to fulfilled them if it turns out that you intended to keep them”.
The renowned legal practitioner noted text messages and all forms of message are forms of evidence that can be used in court adding that anyone who uses such platforms to make promises has shot himself on the foot he does not intend to keep has short himself in the foot since it can be used against them in court.
Justice Abdulai was contributing to discussions on the law suit filed by a Ghanaian young lady against his former boss who was supposedly his lover for a breach of promise to among other things marry her.

Deborah Seyram Adablah, a former Service Person at the First Atlantic Bank Seventh Avenue, Ridge West in a writ of summon dated January 25, 2023 sued Mr Ernest Kwasi Nimako, Director of Finance at the bank for breach of promise to give her a lump sum of working capital, pay her rent for three years, buy her a car, pay her ₵3000 monthly stipends and buy her a ring also.
She is praying the court to compel his former boss and allege lover to fulfill to the latter the promises he made some of which he has fulfilled half way.
