Special Prosecutor engaging In Illegality for not Investigating Anas – Counsel for Charles Bissue argues – Skyy Power FM

Nana Agyei Baffour Awuah Esq, counsel for the former Secretary to the Inter-Ministerial Committee on Illegal Mining (IMCIM), Charles Bissue, has argued that the Special Prosecutor, Kissi Adjabeng has engaged in illegality for having “failed” to investigate Investigative journalist, Anas Aremeyaw Anas in respect of allegations made in the 2019 Galamsey Fraud Part 1 documentary.

According to him, the former Special Prosecutor, Martin Amidu had indicated that Anas Aremeyaw was a subject of investigation in the very matter he petitioned the Office of the Special Prosecutor.

Speaking to the media after today’s hearing at the Accra High Court Complex, Nana Agyei Baffour Awuah argued that it is strange the current Special Prosecutor, Kissi Adjabeng has struck out Anas Aremayaw Anas from its investigations into the matter. He indicated that for this reason and others, the Plaintiff [Charles Bissue] filed a suit to restrain the Special Prosecutor from investigating and prosecuting him.

“Mr Martin Amidu, the former Special Prosecutor wrote an article and stated in there that apparently the Special Prosecutor Mr Kissi Adjabeng is the one who wrote the petition invoking the powers of the Special Prosecutor, and indeed he was also investigating Anas whiles he was in office in respect of this matter.
“And so, it is the current Special Prosecutor who then has decided not to investigate Anas in this matter. That then raised some curiosity necessitating the instant application to bring to the court’s attention that indeed it would be irrational for the Special Prosecutor to continue with its investigation and or prosecution of Mr Charles Bissue” he clarified.

… because we think that he’s acted in a manner which is illegal to the extent that Anas is not a subject of this investigation,” he emphasized.

He indicated that the Special Prosecutor has on two occasions refused to provide the court with the petition that Anas Aremeyaw Anas filed invoking the powers of the OSP to investigate and prosecute Mr Bissue. Nana Baffour Awuah disclosed that the current Special Prosecutor, Kissi Agyabeng, wrote the petition that occasioned this investigation by the OSP.

He thinks that the refusal of the Special Prosecutor to make available the petition and also investigate Anas Aremeyaw Anas in this matter raises some eyebrows.

“Prior to the filing of this suit, we made a request for the petition that necessitated the investigation. On two occasions, we’ve made that request and the Special Prosecutor has refused to make that petition available to us.
“We thought that they were all leading to a certain conclusion or they were suggestive,” he argued.
The court has been adjourned to 12 June 2023 for the hearing of the motion for discovery, and the substantive suit which is seeking to restrain the OSP from investigating and prosecuting Mr Charles Bissue.

Anas & Tiger Eye P.I Withdraw Application Seeking to Be Strike Out of the Suit
Counsel for the 2nd and 3rd Defendant [ Anas Aremeyaw Anas, and Tiger Eye P.I], Evans Selassie told the court, their application filed on 22 March 2023 which was seeking to have his clients strike out from the suit, has been withdrawn.

It would be recalled the OSP in its notice of conditional appearance filed on 11 January 2023, did argue that the Anas Aremeyaw Anas and the Tiger Eye P. I cannot be joined to the suit, as they are considered whistle-blowers.
