Private legal practitioner Martin Kpebu has said that the Constitution will be amended to remove the immunity the President enjoys against prosecution in order to prosecute President Nana Addo Dankwa Akufo-Addo when he leaves office.
This was after he accused Data Bank and its co-founder the Finance Minister Ken Ofori-Atta of benefiting from every loan agreement that the government took.
The President, in whom all executive authority of the State is vested, is the only public officer granted absolute immunity from civil and criminal processes while in office [(Article 57 (4)].
This is to enable the President to perform the duties of his/her high office without any distractions occasioned by civil and criminal processes.
Kpebu said on the Key Points on TV3 Saturday, February 18 “As for that money, they will vomit it.”
He was contributing to a discussion on the domestic debt exchange programme (DDEP).
He added, “we have to amend the constitution and remove the immunity and prosecute the President.”
Regarding the DDEP, the Finance Minister briefed Parliament on Thursday, February 16,
He told Parliament that he has met the pensioners who have been picketing to protest their inclusion in the programme three times.
He said he has explained to them the terms of the new bonds
Briefing Parliament on Thursday, February 16, he said “government is committed to the wellbeing of our senior citizens and pensioners. The government will honour their coupon payments and maturing principles.”
He added “I have met with them on three occasions where I explained the terms of the new bonds. I subsequently wrote to their convener to let him know that all pensioners who did not participate in the bond offerings are exempt.”
