James Quayson’s election annulment: Gross miscarriage of justice – Sammy Gyamfi

Vida Essel-LampteyThe Director of Communications of the National Democratic Congress (NDC), Mr Sammy Gyamfi has described the annulment of the election of the Member of Parliament for the Assin North Constituency by the Cape Coast Court as a gross miscarriage of justice.
Speaking on TV3 Midday News barely an hour after the court decision, he said the NDC would do everything possible within the confines of the law to ensure the party and the MP were given justice in the matter.
He explained under the circumstances, the only option available to the party was to rely on the laws of the country and hinted the party would file a stay of execution of the court’s decision.
“The way forward is simple, we as a law abiding party and Member of Parliament for Assin North, Hon. James GYakye Quayson are determined to use the laws of this country to ensure that justice is done in this matter so our only hope lies in the laws of this country and that is what we will resort to under this circumstances”, he said in the interview monitored by GhanaPlus.com.
“…….I informed by the lawyers that a stay of execution to will be filed in the Court of Appeal in accordance with the law and all other things necessary to ensure that this judgment which in our view is a grieve or gross miscarriage of justice’s arrest will be done immediately,” Mr Gyamfi added.
The suit and Court ruling
The Cape Coast High Court on Wednesday, July 28, ruled for a fresh election to be held in the Assin North Constituency following a suit challenging the dual citizenship of the MP, James Gyakye Quayson.
The suit was filed by a private citizen, a mason and a resident of Assin Berekum, Mr Micheal Ankomah Nimfah, at the Cape Coast High Court challenging the qualification of Mr Quayson as the MP-elect for the area.
The plaintiff averred that at the time Mr Quayson filed his nomination, he was still holding onto his Canadian citizenship and failed to denounce his citizenship as required by law.
Ruling on the case, trial judge Justice Kwasi Boakye noted that it would be a scar on the country’s legal jurisprudence if the error is not addressed.
The court also said it would be a cancerous tumour should the December 2020 parliamentary poll results was allowed to stand.
