Mahama prays Supreme Court to annul 2020 Presidential results

The flag bearer of the opposition National Democratic Congress, John Dramani Mahama has petitioned Ghana’s Supreme Court to among other things declare the results of the 2020 Presidential elections null and void.

According to a petition filed by his legal team led by the renowned legal practitioner, Tony Lithur, the election results declared by the  Chairperson of the Electoral Commission, Mrs. Jean Mensa breaches the 1992 Constitution hence should be declared unconstitutional.

“The declaration that Mrs Jean Mensa, Chairperson of 1^st Respondent and the Returning Officer  for the Presidential Elections held on 7^th December 2020 was in breach of Article 63(3) of the 1992 Constitution in the declaration she made on 9^th December 2020 in respect of the Presidential Election that was held on 7^th December 2020;

A declaration that base on the data contained in the declaration made by Mrs. Jean Adukwei Mensa Chairperson of 1^st Respondent and the Returning Officer for the Presidential Elections held on 7^th December 2020, no candidate satisfied the requirement of Article 63(3) of the 1992 Constitution to be declared as President-elect

A declaration that the purported declaration made on 9^t0h December 2020 of the results of the Presidential Election by Jean Adukwei Mensa, Chairperson of 1^st Respondent and the Returning Officer for the Presidential Elections held on 7^th December 2020 is unconstitutional, null and void and of no effect whatsoever.

Mr. Mahama is also seeking a restraining order from the court to prevent the President, Nana Addo Dankwa Akufo-Addo from holding himself as the President-elect of Ghana and a subsequent order to compel the EC to conduct another election between the two leading candidates of the 2020 elections.

 An order annulling the Declaration of the President-Elect Instrument, 2020 (C.I.135) dated 9^th December issued under the hand of Mrs. Jean Adukwei Mensa, Chairperson of 1^st Respondent and the Returning Officer for the Presidential Elections held on 7^th December 2020 and gazetted on 10th December 2020;

“An order of the injunction restraining the 2^nd Respondent from holding himself out as President-elect”.

“An order of mandatory injunction directing the 1^st Respondent to proceed to conduct a second election with petitioner and 2^nd Respondent as the candidates required under Article 63(4) and (5) of the 1992 Constitution”.
