Am grateful: Mahama Ayariga tells Special Prosecutor

Vida Essel-LampteyThe Member of Parliament for the Bawku Central, Mahama Ayariga has expressed appreciation to the Special Prosecutor, Mr Kissi Agyebeng for dropping all charges against him.
The Special Prosecutor on Monday, October 11 at a Court in Accra dropped all charges against, the MP in a tax evasion case brought against him by the former Special Prosecutor, Mr Martin Amidu.
According to him, the state could not prove beyond reasonable doubt the accusation against the MP and subsequently filed a nolle prosequi to discontinue.
“We wish to inform the court of the republic’s intention to enter Nolle prosequi in respect of all cases against the accused person,” he said.
“…..Upon further scrutiny, the Republic deem it unable to prove its case base on available evidence on the standard of proof on criminal bases – that is to prove beyond a reasonable doubt.”
“This case appears certain to suffer the same fate as the earlier one with case number FT0122019 the Republic vs Hawa Nichema and six others which were dismissed on May 7, 2021, on the application of submission of no case to answer,” the Agyebeng told the court.

However, speaking on behalf of Mr Ayariga after the proceedings, his lawyer, Mr Godwin Edudzi Tamakloe said the decision by the Special Prosecutor took them by surprise and expressed their appreciation to him.
He explained Societe Generale, a bank at the center of the transaction had revealed, Mr Ayariga benefited from a car loan and deduction for repayment had begun subsequently.
“We need to thank the new Special Prosecutor for allowing reason and fairness to prevail,” he said, pointing out that Mr Agyebeng made the move in “good conscience,” Mr Edudzi Tamakloe said.
“We are grateful to him and we are grateful to the court for what has happened today,” he added.
The Special Prosecutor, Mr Kissi Agyebeng on Monday, October 11, dropped all charges against the Nation Democratic Congress(ND) MP citing reasons the state per evidence available to them was unable to prove reasonable doubt, a crime against him.
Ayariga’s Charges
Mr Mahama Ayariga was in court over charges of abuse of office and tax evasion for purchasing three Toyota V8 vehicles.
He was again being charged for transferring foreign exchange to Dubai without the necessary documentations.
It was one of two cases brought against him, by the former Special Prosecutor, Mr Martin Amidu in which the court acquitted and discharge him and six others in the other.
